Suburbly (operated by The Blue Water Community Trust – ABN: 13 636 334 474) (“we”, “us”, “our”) provides the website suburbly.com.au, associated subdomains (e.g., suburbly.com.au/4017), and related services (collectively, the “Platform”), including a hyperlocal business directory for Australian suburbs/postcodes.

These Terms and Conditions (“Terms”) govern your access to and use of the Platform, including browsing, registering, submitting listings (free or paid), posting content, and any interactions. By accessing or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

1. Eligibility and Accounts

You must be at least 18 years old (or have guardian consent) to use the Platform. To submit listings, post content, or purchase paid features, you need a registered account. You are responsible for keeping your account details secure and for all activity under your account. Notify us immediately of any unauthorised use at support@suburbly.com.au.

2. Business Directory Listings

The Platform allows businesses to create free basic listings or upgrade to paid premium listings (e.g., featured placement, enhanced profiles, priority in search results, additional photos, or analytics).

  • Free Listings: Basic information (business name, address, contact details, category, description) is displayed publicly in the relevant postcode/suburb. Free listings are provided “as is” with no guarantees of visibility, ranking, or performance. We may moderate or remove listings that breach these Terms.
  • Paid Listings: Upgrades provide enhanced features for a fee (pricing displayed at time of purchase). Payment is processed via [insert payment provider, e.g., Stripe]. Fees are non-refundable except where required by law (see section 9). Paid features are subject to availability and may change with notice.

All listings must be accurate, current, and relate to legitimate businesses operating in or serving the relevant suburb/postcode. You warrant that all information you submit (including images/logos) is true, not misleading, and you own or have rights to use it.

3. User-Generated Content and Conduct

You may submit listings, reviews, comments, photos, events, or other content (“Your Content”). By submitting, you grant us a non-exclusive, royalty-free, worldwide licence to use, display, modify (for formatting), and distribute Your Content on the Platform.

You agree not to post:

  • False, misleading, or deceptive information (prohibited under Australian Consumer Law)
  • Infringing, defamatory, offensive, or unlawful content
  • Spam, scams, or unauthorised advertising

We may review, moderate, edit, or remove content at our discretion (no obligation to do so). We are not responsible for user content.

4. Our Role and Disclaimers

The Platform is an information and community service only. We do not:

  • Verify the accuracy, quality, or legitimacy of listings, businesses, or user content
  • Act as an agent, broker, or provider of goods/services listed
  • Endorse any business or guarantee outcomes from using listings

All content is provided “as is”. To the extent permitted by law, we disclaim all warranties (express or implied) regarding the Platform, listings, or availability.

5. Limitation of Liability

To the maximum extent permitted by law (including under Australian Consumer Law), we are not liable for any loss or damage (direct, indirect, consequential) arising from:

  • Use of or reliance on the Platform or listings
  • Business transactions between users and listed businesses
  • Technical issues, downtime, or data loss

Nothing in these Terms excludes or limits rights under the Australian Consumer Law that cannot be excluded.

6. Intellectual Property

The Platform (design, text, logos, software) is owned by us or our licensors. You may view and use content for personal, non-commercial purposes only. Do not copy, reproduce, or commercialise without permission.

7. Paid Features and Payments

Paid listings are subscriptions or one-off fees. You authorise recurring charges if applicable. Prices include GST where required. We may suspend or remove paid features for non-payment or breaches.

8. Termination and Suspension

We may suspend or terminate your account/listing at any time for breaches of these Terms, with or without notice. You may close your account anytime.

9. Refunds and Australian Consumer Law

Refunds for paid features are provided only where required by law (e.g., major failure under consumer guarantees). For minor issues, we may offer remedies like replacement features. Contact us at support@suburbly.com.au for issues. Consumer guarantees under the Australian Consumer Law apply to paid services and cannot be excluded.

10. Changes to Terms

We may update these Terms. Continued use after changes constitutes acceptance. Check the “Last updated” date.

11. Governing Law and Disputes

These Terms are governed by Queensland law. Disputes are subject to the non-exclusive jurisdiction of Queensland courts.
